• Solicitor services or recommendations
• Guaranteed outcomes or results from correspondence
• Tax, accounting, or financial advice

By using NudgeBadger, you acknowledge that:

• Letters generated are templates based on general information, not your specific legal situation
• You are solely responsible for the use and accuracy of any correspondence you send
• You should consult a qualified solicitor before taking formal legal action
• Any reliance on our information resources is entirely at your own risk

2. About NudgeBadger

NudgeBadger ("we", "us", "our", "NudgeBadger") operates the website nudgebadger.co.uk and provides an AI-assisted tool that generates invoice chasing letter templates for UK freelancers and small businesses.

Always review any letter before sending it. If you are pursuing a debt through the courts or require formal legal assistance, please consult a qualified solicitor.

3. User Responsibilities

By using NudgeBadger you agree to:

• Provide accurate information when generating letters
• Review every letter before sending; you are solely responsible for its content and use
• Use letters only for genuine, lawful debt recovery purposes
• Ensure all correspondence complies with applicable laws in your jurisdiction
• Obtain independent legal assistance where appropriate
• Ensure you have the legal right to pursue the payment claim in question
• Comply with all applicable laws and regulations when chasing payment
• Not use the service to harass, threaten, or defame any individual or organisation
• Not attempt to reverse engineer, scrape, or abuse the platform

You must be 18 or over and acting in a business capacity to use NudgeBadger. The service is intended for UK-based users and is governed by English law.

4. Information Resources Only

NudgeBadger's knowledge base, help articles, escalation resources, and any information provided through the platform are:

• General information resources only, not professional legal advice
• Not tailored to your specific situation or legal circumstances
• Provided for reference and convenience purposes only
• Not a substitute for qualified legal assistance

We provide these resources on an "as-is" basis with no warranty as to their accuracy, completeness, or fitness for any particular purpose.

5. Plans and Pricing

Prices shown on the Pricing page are in GBP and include VAT where applicable. Payments are processed securely by Stripe. We do not store card details.

6. Cancellation

If you have trouble accessing the billing portal, email us at hello@nudgebadger.co.uk and we will cancel on your behalf within 1 working day.

7. Refunds

These terms are in addition to your statutory rights under the Consumer Contracts Regulations 2013. As a digital service that you can begin using immediately, you are asked to waive your 14-day cooling-off right at the point of purchase; however, we voluntarily honour a 14-day refund if the service has not been used.

To request a refund, email hello@nudgebadger.co.uk with your account email and order details. Refunds are processed within 5–10 working days back to your original payment method.

8. Account Deletion

You can request full deletion of your NudgeBadger account at any time. This removes your profile, all generated letters, and your tracker history. To delete your account:

• Email hello@nudgebadger.co.uk with the subject line "Delete my account"
• If you have an active subscription, cancel it first from Account > Manage Billing to avoid further charges
• We will confirm deletion within 5 working days and complete it within 30 days

Billing records required by law (7 years) are retained by Stripe but contain no letter content or profile data.

9. Intellectual Property

The NudgeBadger platform, brand, and underlying technology are owned by us. You retain full ownership of any letter content you create using NudgeBadger; we make no claim to the letters you generate or send.

You grant us a limited licence to store and display your letter content solely for the purpose of providing the service (e.g. showing letters in your Tracker).

10. Limitation of Liability

NudgeBadger provides templates and information resources only. To the maximum extent permitted by UK law, we are not liable for:

• Whether a letter results in payment or any other outcome
• Any financial losses, damages, or claims arising from your use of the service
• Any dispute arising from a letter you send
• Inaccuracies in letters caused by incorrect information you provided
• Any third-party actions or responses to correspondence you send
• Any claim that letters are ineffective, inappropriate, or in breach of any law
• Recovery claims brought by insurance companies or other third parties in connection with correspondence you sent
• Loss of income, revenue, or business opportunity of any kind

To the maximum extent permitted by law, our total liability to you for any claim arising from use of NudgeBadger is limited to the total amount you paid to NudgeBadger in the 12 months preceding the claim, or £100, whichever is lower.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable UK law.

11. Indemnification

You agree to indemnify, defend, and hold harmless NudgeBadger and its directors, employees, and contractors against any claims, losses, costs, or liabilities (including reasonable legal fees) arising from:

• Your use of generated letters or information resources
• Any third-party claims, including claims by insurance companies, related to correspondence you sent
• Any breach of these Terms of Service
• Any claim that you lacked authority to pursue a payment or debt
• Any claim related to the accuracy, legality, or appropriateness of correspondence you sent
• Any violation of applicable laws in connection with your use of NudgeBadger

12. Service Availability

We aim to keep NudgeBadger available at all times but cannot guarantee uninterrupted access. Maintenance windows, third-party outages (e.g. Firebase, Stripe, AI provider), or unexpected issues may temporarily affect availability. We are not liable for losses caused by downtime.

We reserve the right to modify or discontinue features with reasonable notice. Paid subscribers will receive at least 30 days' notice before any material reduction in the service they have paid for.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from the use of NudgeBadger will be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Changes to These Terms

We may update these terms from time to time. We will notify you by email and update the date at the top of this page. Continuing to use NudgeBadger after changes take effect means you accept the revised terms.
